Philip Black is a graduate of the University of Notre Dame (B.B.A., 2011, summa cum laude), where he received the Brother Cyprian, C.S.C. award for achieving the highest grade point average among Accountancy majors. Philip then attended the University of Minnesota Law School (J.D., 2014, magna cum laude), where he was Editor-in-Chief of Volume 29 of the ABA Journal of Labor & Employment Law. Philip joined Wolf Popper in 2020 after serving as an Assistant Attorney General in the Litigation Bureau of the New York State Office of the Attorney General. 

Experience

Phil’s representative consumer litigation matters include:
  • In re Capital One 360 Savings Account Interest Rate Litigation: Led the litigation team in this multidistrict class action, defeating a National Bank Act preemption defense and securing a settlement with estimated value exceeding $1 billion.
  • Leventhal v. Streamlabs LLC: Secured a $4.4 million settlement in a class action involving allegations concerning enrolling and charging consumers for an automatically renewing subscription without their consent.
  • Pliszka v. Axos Bank: Successfully obtained dismissal of a Ninth Circuit appeal in connection with a motion to compel arbitration.
  • Valelly v. Merrill Lynch: Defeated summary judgment and achieved class certification in a class action involving interest rates paid on cash sweep programs for Merrill Lynch retirement accounts.
  • In re E*Trade Cash Sweep Litigation: Wolf Popper was appointed lead counsel in a class action concerning interest rates on cash sweep programs for E*Trade and Morgan Stanley accounts.
  • Casey v. Doctor's Best, Inc.: Secured a settlement providing refunds to purchasers of an allegedly mislabeled glucosamine dietary supplement.
  • Kaur v. Envision Healthcare Corp.: Secured a settlement providing refunds to class members in a healthcare surprise billing case.
     
Phil also leverages his legal experience and accounting background as a contributor to Wolf Popper’s securities litigation team, including:
  • In re Conduent Securities Litigation (settled for $32 million)
  • In re WideOpenWest Securities Litigation (settled for $7 million)
  • Hermann v. Midnight Hub (lead counsel in ongoing digital asset litigation)
     
Phil is a frequent participant at bar and consumer finance conferences and was a featured panelist at the 2026 New York City Bar Consumer Financial Law Conference, where he spoke on the panel “In re Capital One 360 Savings Account Interest Rate Litigation: A View from Class Counsel and the AG.”
