Chosen Foods LLC Consumer Litigation

Wolf Popper is counsel for the plaintiff in a putative class action lawsuit against Chosen Foods LLC arising out of Chosen Foods’ sale of products that claim they contain 100% pure avocado oil but do not.
 
Chosen Foods sells a variety of food products that all claim to contain 100% pure avocado oil.  These include not only pourable and sprayable avocado oil, but condiments such as salad dressings, marinades, and mayonnaise that are all supposed to be made with avocado oil.  The company’s products all highlight their use of avocado oil.  They have statements such as “made with 100% pure avocado oil” and pictures of avocados on their labels.  Meanwhile, the ingredient list only mentions avocado oil and no other oils.  Their marketing materials also make it clear that Chosen Foods’ products are not supposed to include seed oils and other “bad fats.”



Many consumers prefer to use avocado oil and avoid other types of oil, such as seed oils, and they are willing to pay a premium price for authentic avocado oil products.
 
Unfortunately, recent research from the University of California, Davis showed that several of Chosen Foods’ products do not actually contain avocado oil.  By measuring the amount of fatty acids and sterols in multiple samples using gas chromatography, the researchers found that the oils in the products did not match the chemical “fingerprints” for avocado oil.  According to the research, several other companies are also selling products that do not appropriately contain avocado oil, including Primal Kitchen, Jacksons, and Boulder Canyon.
 
Wolf Popper filed a complaint on behalf of consumers nationwide in federal court in California.  The name of the case is Treasure v. Chosen Foods, LLC, 3:26-cv-04606-DMS-BJW (S.D. Cal.).  A recent article in Law360 quoted Wolf Popper partner Phil Black, saying “"Consumers should be able to rely on product labels, particularly when they are paying a premium for a specific ingredient . . . . Our complaint alleges that these products did not contain 100% pure avocado oil as advertised, and we look forward to pursuing these claims on behalf of consumers who purchased them."
