Utz Brands, Inc. sells various Boulder Canyon potato chip products that are marketed as being made with avocado oil. The packaging, ingredient statements, and marketing materials identify avocado oil as the oil used in these products, and the company has represented that its Boulder Canyon products are made exclusively with the oil identified on the label.
However, testing conducted by researchers at the University of California, Davis found that recovered oils from certain avocado-oil-labeled Boulder Canyon potato chips were not consistent with the composition of authentic pure avocado oil. The lawsuit alleges that consumers purchased these products and paid a premium based on representations that they contained avocado oil and no other oils.
According to the complaint, consumers were willing to pay higher prices because avocado oil is widely viewed as a premium ingredient and because Utz marketed these products as part of its better-for-you snack portfolio. The lawsuit seeks to recover damages and other relief on behalf of purchasers nationwide.
