Sony engaged in a practice of marketing and bundling a perpetual license for post-production editing software, called Capture One Express for Sony, with its cameras—only for Capture One (or Sony Electronics acting on Capture One’s behalf) to improperly revoke this license, which forced users to pay for continued access to software they believed was part of their original camera purchase.
Purchasers of Sony cameras use post-production software to edit, organize and manage their photo collections. This included Capture One Express for Sony software was a valuable portion of the camera package sold to consumers, and terminating access to this valuable software harmed consumers that opted to pay to continue using Capture One software (avoiding substantial switching costs), consumers that paid for substitute software, and even consumers that did not use post-production software, because the resale value of their cameras would be less without bundled, effective, post-production software.
The case is Rodriguez v. Sony Electronics Inc. et al., Case No. 25-cv-2305-WQH-SBC, (S.D. Cal.), pending in the United States District Court for the Southern District of California.
