The plaintiff alleges that Capital One routinely failed to provide the promised payouts even when cardholders complied with the program’s requirements. The plaintiff, for example, claims that he made purchases from Zappos after activating Capital One Offers promising 6% and 3% cash back, but never received the additional rewards. He also alleges that, on other occasions, Capital One issued missing payouts only after he contacted customer service, leaving customers responsible for identifying and pursuing rewards that should have been credited automatically.
The lawsuit alleges that Capital One breached its contractual obligations and the implied covenant of good faith and fair dealing by failing to implement adequate policies and procedures to ensure that qualifying cardholders received the rewards they were promised. The plaintiff seeks to represent a nationwide class of Capital One cardholders who activated qualifying offers and did not receive the corresponding payouts. The action seeks damages, payment of outstanding rewards, and changes to Capital One’s practices to ensure that future payouts are issued as promised.
