He will be joined on the panel by Frederic Fox (Kaplan Fox & Kilsheimer LLP) and Serena Hallowell (Motley Rice), moderated by Amy Fecher (Executive Director, Arkansas Public Employees’ Retirement System).
Panel Description: There are a number of factors that go into an outside securities litigation firm’s recommendation for, or against, active participation in a potential securities litigation, including the merits of the claim, the fund’s losses in the relevant security, and potentially recoverable damages. In this session, the panelists will discuss the various factors that go into an analysis of active participation in a potential securities litigation, how they inform the analysis, and how they relate to one another. Panelists will also discuss how these factors impact the fund’s decision on whether to be an active or passive participant in a securities litigation, and what considerations can be taken from the analyses to give the Fund the best mode of recovery.
