Timeshare and Vacation Telemarketing Calls Consumer Litigation
Type: Current Cases
Case Number: 1:26-cv-09409
Defendant(s): RCI, LLC, Travel + Leisure Co., Hilton Grand Vacations Inc.
Court: United States District Court for the Southern District of New York
RCI, Travel + Leisure Co., and Hilton Grand Vacations offer timeshares, vacation packages, and other travel services. The complaint alleges that the in order to promote and sell these travel packages, the companies, or telemarketers acting on their behalf, placed calls using artificial or prerecorded voices without obtaining the required prior written consent. It further alleges that the companies called consumers whose telephone numbers were registered on the National Do Not Call Registry.
The lawsuit was filed after a New York resident allegedly received repeated unwanted calls promoting vacation offers, timeshare services, and RCI membership benefits. He alleges that he had never owned a timeshare, done business with the defendants, or given them his phone number. According to the complaint, his telephone number had been listed on the National Do Not Call Registry since 2012. Some of the calls allegedly came from callers identifying themselves only by a first name or using names such as “Picture Perfect Getaways” or “resort fulfillment department,” rather than identifying the company on whose behalf the calls were made.
The action seeks relief on behalf of nationwide classes of consumers who allegedly received repeated telemarketing calls from or on behalf of the defendants in violation of the TCPA. The lawsuit seeks monetary compensation for consumers who received calls in violation of the law. It also asks the court to order the companies to stop making unlawful calls and to implement appropriate telemarketing compliance procedures.
The case is 1:26-cv-09409 and is currently pending in the United States District Court for the Southern District of New York.
