Wolf Popper is counsel for the plaintiff in a putative class action lawsuit against PepsiCo, Inc. and Garza Food Ventures, LLC arising out of the sale of Siete products that claim to be made with avocado oil but allegedly contain other oils.

 

Siete sells a variety of snack products, including potato chips and tortilla chips, that are marketed as being made with avocado oil. The packaging and marketing materials for certain products prominently state “MADE WITH AVOCADO OIL,” while the ingredient lists identify avocado oil as the only oil ingredient. Siete’s marketing materials also state that its chips are fried in avocado oil and emphasize the use of avocado oil as a preferred ingredient.

 

Many consumers prefer avocado oil and seek to avoid other types of oil, such as seed oils. Consumers may also be willing to pay a premium for products marketed as containing avocado oil.

 

However, recent research from the University of California, Davis found that Siete’s Sea Salt Potato Chips and Sea Salt Tortilla Chips contain oils that are not consistent with 100% pure avocado oil. The lawsuit alleges that the products contained oils that were not consistent with pure avocado oil, despite their labels and marketing. The UC Davis research tested the chemical composition of the oils by examining fatty acids and sterol markers used to assess the authenticity of avocado oil.

 

The lawsuit alleges that consumers purchased Siete products based on representations that they contained avocado oil and paid a premium for products marketed as containing this ingredient. Plaintiff alleges that she and other consumers would not have purchased the products, or would not have paid as much for them, had they known the products contained other oils.

 

Wolf Popper filed a complaint on behalf of consumers nationwide in federal court in New York. The name of the case is Lewis v. PepsiCo, Inc. et al., No. 7:26-cv-08794 (S.D.N.Y.).
