Nest Thermostat Investigation
Type: Investigations
Defendant(s): Google
Product(s): Nest Thermostat
Google has discontinued support for certain Nest thermostat models, resulting in the loss of app-based and other connected features. For affected thermostats, owners may no longer be able to control their thermostat through the Nest or Google Home apps, use connected features such as Home/Away Assist, or receive software and security updates. While some affected thermostats continue to function as basic thermostats, the loss of connected functionality may eliminate features that were included with the device at the time of purchase and that owners may have reasonably expected to remain available.
Some Nest thermostat owners have reported frustration with the loss of these features, particularly where they purchased their thermostats as “smart” home devices with WiFi connectivity and app-based functionality. For consumers who relied on remote access, connected-home features, or other smart functionality, the loss of these features may significantly change the functionality and value of the product.
As smart-home devices become increasingly dependent on software and connected services, the discontinuation of functionality raises questions about whether manufacturers can remove or disable features after consumers have purchased products based on their advertised capabilities.
