Allstate Insurance Rental Car Coverage Investigation

If you were involved in a car accident that was not your fault and the other driver was insured by Allstate, you may have been directed to obtain a rental car, but later were not fully reimbursed for the costs, requiring you to pay part of the cost out-of-pocket. Wolf Popper LLP is investigating reports involving Allstate’s handling of rental car coverage for individuals who are not Allstate policyholders but were involved in accidents caused by drivers insured by Allstate.
When a driver is not at fault for an accident, the at-fault driver’s insurance company is generally responsible for covering certain costs, including a rental vehicle while the damaged car is being repaired. In these situations, some individuals report that Allstate directed them to specific rental car providers, including preferred partners, to obtain a rental vehicle.
However, some consumers have reported that, after returning the rental car, they were informed that Allstate would only cover a portion of the rental cost. These limitations may be based on daily rate caps, vehicle class restrictions, or other internal guidelines that were not clearly disclosed at the time the rental was arranged.
In certain cases, individuals say they were not offered rental options that would fall within Allstate’s unstated coverage limits. Instead, they selected from the available vehicles, without being informed that doing so could result in out-of-pocket charges.
Because these individuals are not Allstate policyholders, they typically do not have a contractual relationship with Allstate and may not have received clear written terms outlining rental coverage limits, reimbursement policies, or applicable restrictions.
Failing to adequately disclose such limitations may raise concerns under state consumer protection laws.
