Alternative Fee Arrangements

Wolf Popper enters into a variety of fee arrangements with our clients.

These arrangements encompass fully contingent, fixed fee, and hourly models or hybrids that combine contingent, fixed, or hourly components, as appropriate for a given matter. 

Alternative fee arrangements (AFAs) can be used to ensure that both parties have “skin in the game,” and outside counsel are motivated to champion the client’s cause efficiently. AFAs also provide access to the legal system for clients with worthy claims but insufficient funds to sue. In many circumstances, AFAs allow for greater control over legal spend, providing certainty better than the traditional billable hour system. 

Our flexibility allows both the Firm and our clients to align incentives and interests while balancing flexibility and predictability. 
Fee arrangements can include some or all of the following: 
 
  • Contingency fee agreements drive results by rewarding lawyers for effectively and efficiently resolving our clients’ disputes, penalize busy-work, and prevent an endless stream of bills for our clients. 
  • Fixed fee agreements are built with an eye to budgeting. Fixed fees provide both predictability and accountability. After taking the time to understand the particulars of our client’s needs and the specifics of a particular case, we work with the client to tailor a fair, fixed fee arrangement that accounts for the inevitable ebb and flow of a particular litigation. Fixed fees protect our clients from the uncertainty and monitoring burden of tradition-bound hourly billing. 
  • Hybrid fee agreements provide virtually unlimited flexibility. These structures can combine a fixed or hourly fee at a reduced rate with a partial contingent or success-bonus component to best suit the particulars of a specific matter. Hybrid agreements reduce the out-of-pocket expense of a fixed or hourly representation while aligning interests in achieving favorable results. 
  • Hourly fee agreements can be preferable for some clients for certain matters. In such instances, having lawyers who understand that results and efficiency truly matter is quite beneficial. 

We are amenable to each of these types of fee agreements and pride ourselves on having flexibility to find the right fee agreement for each client’s situation.
