Court Grants Preliminary Approval of Settlement in Capital One 360 Savings Interest Rate Litigation

On January 12, 2026, the Honorable David J. Novak of the United States District Court for the Eastern District of Virginia entered an order granting preliminary approval of the class action settlement in the In re: Capital One 360 Savings Account Interest Rate Litigation. The settlement resolves claims asserted by Wolf Popper LLP on behalf of Capital One 360 Savings accountholders nationwide and provides for $425 million in relief for class members. Further, the settlement requires Capital One to raise interest rates for class members who continue to hold 360 Savings accounts to match the rates paid to 360 Performance Savings accountholders. Court-approved notice of the settlement will be disseminated to all identified class members no later than February 2, 2026.
