Wolf Popper Files Derivative Lawsuit Targeting Caterpillar Tax Evasion Scheme

Wolf Popper has filed a derivative lawsuit in the Delaware Court of Chancery on behalf of Caterpillar Inc. against various current and former officers and directors of the company.  The complaint alleges that these defendants exposed the company to billions of dollars in liabilities by agreeing to and accepting an illegal, and possibly criminal, scheme to evade billions of dollars in U.S. taxes by improperly shifting profits to a Swiss affiliate.  An article published by Law360 that discusses the lawsuit is attached here.
