Michele Fried Raphael is a partner of Wolf Popper LLP and has been with the firm since January, 1995. She represents consumers and shareholders in consumer fraud and securities fraud class actions. Among her recent cases are consumer actions against Google, Inc. and TJX Companies, Inc. The class action against Google was on behalf of advertisers who claimed they were overcharged by Google and the action against TJX Companies, Inc. was on behalf of consumers whose personal information was compromised due to a security breach at the company’s headquarters. She has also represented classes of consumers in actions against eight title insurance companies and Toys “R” Us, Inc. The action against the title insures, In re Coordinated title Insurance Cases, resulted in the largest consumer settlement in Nassau County. The presiding Justice commented that the lawyering in the case “was lawyering of the highest quality.”
Ms. Raphael has also actively represented plaintiff classes in actions against American Bankers Insurance Group, Inc. (defendant paid nationwide class members' insurance claims in full and revised its solicitations), First Consumers National Bank (defendant reimbursed credit cardholders nationwide for all fees they had paid which allegedly had been disclosed in impermissibly fine print), and Deutsche Bank A.G.(in a securities action arising from defendant's merger with Bankers Trust, the settlement recovered 96% of the class' most likely recovery). She is also involved in general commercial litigation and has represented Aeroflot Russian Airlines in a variety of matters.
Her reported decisions include Good v. American Pioneer Title Ins. Co., 2 A.D.3d 401, 783 N.Y.S.2d 841 (2d Dep't 2004); Spector v. Toys "R" Us, Inc., 12 A.D.3d 358, 784 N.Y.S.2d 153 (2d Dep't 2004); Sims v. First Consumers Nat'l Bank, 303 A.D.2d 288, 758 N.Y.S.2d 284 (1st Dep't 2003) and DiBenedetto v. Pan Am World Serv., 359 F.3d 627 (2d Cir. 2004).
Ms. Raphael received her Juris Doctor from Hofstra University School of Law where she was a member of the Hofstra Law Review, a student member of the Theodore Roosevelt American Inn of Court and an intern for the Honorable Judge George C. Pratt on the United States Court of Appeals for the Second Circuit. She holds a B.A. from the State University of New York at Binghamton, where she was elected into Phi Beta Kappa.
Ms. Raphael is admitted to the New York State Bar, the United States District Courts for the Eastern and Southern Districts of New York and the United States Court of Appeals for the Second Circuit. She is a member of the Theodore Roosevelt American Inn of Court and the Nassau County Bar Association.
